The Sex Discrimination Lawsuit 

Pretium Packaging’s Leipsic, Ohio facility was accused of maintaining a discriminatory practice of excluding women from machine operator positions. Female employees who expressed interest in these roles were explicitly told that they were ineligible solely based on their gender.  

The company’s hiring decisions favored male employees and external applicants, even when they possessed inferior qualifications. Additionally, Pretium failed to maintain adequate personnel records, which is a violation of federal law. 


Violations of Title VII of the Civil Rights Act 

The conduct described in the lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) against Pretium Packaging violated Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on sex.  


This legislation ensures that individuals have equal opportunities regardless of their gender. The EEOC initiated the lawsuit in the U.S. District Court for the Northern District of Ohio, seeking resolution and justice for the victims (Case No: 3:22-cv-01729). 


The Terms of the Consent Decree 

To settle the lawsuit, Pretium Packaging agreed to a three-year consent decree. The company will pay over $125,000 to two female employees who were denied interviews for machine operator positions. An additional group of former female employees who may have been interested in the roles will receive $2,500 each.  

In a collaborative effort with the Ohio Chapter of Women in Manufacturing, Pretium will establish a $75,000 scholarship. Graduates from the program will be considered for machine operator, supervisor, or manager positions. The company must also conduct annual training on sex discrimination for all employees at the Leipsic facility and submit reports regarding its hiring practices.

The settlement highlights the significance of treating all employees equally, regardless of their gender. Denying women the opportunity to operate machines based on outdated stereotypes is both unlawful and unacceptable.
